Using this site
You may use this site to learn about Helixs, contact the studio and apply for a store.
Do not misuse it. For example, do not try to get around its security or bot checks, overload it with automated requests, or send false details.
The information on this site is general. It describes Helixs as it is today and may change.
Applications and proposals
An application or an enquiry does not create a contract. It does not commit you or us to anything.
After a call, we may send you a proposal. It sets out the scope, the price and the date it is valid until.
Nothing is binding until you accept a proposal before that date.
Accepting a proposal
A one-off fee is billed by invoice. You pay the invoice securely on Stripe's page.
A monthly fee is a recurring charge. We invoice it through Stripe each month from the date you accept, until it is cancelled under the terms agreed in your proposal.
Each invoice shows its due date.
To stop a monthly fee, tell us in writing. We cancel it under the terms agreed in your proposal, and we issue no further monthly invoices after it ends.
The proposal you accept and these terms together form the agreement between you and us.
Prices and GST
Prices are in Australian dollars.
Each proposal states whether its prices include GST or GST is added.
The proposal also lists third-party services, such as Stripe's card fees on your store's sales. Stripe charges those fees to your own Stripe account. They are not part of our invoices.
Intellectual property
The content and design of this site belong to Divergent Digital Studio or to the people who license them to us.
You may view this site and share links to it. Do not copy or republish its content without our permission.
Our liability
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
Apart from those rights, and to the extent the law allows, we are not liable for any loss that comes from using this site or relying on its general information.
Governing law
These terms are governed by the law of Victoria, Australia. You and we agree to the jurisdiction of the courts of Victoria.
Changes to these terms
We may update these terms. The date at the top of this page shows when they last changed.
If you have accepted a proposal, the terms that applied when you accepted it continue to apply to it.
